Apple Inc and Eminem have failed to settle a lawsuit over whether the rapper's songs can be downloaded on the iTunes music service, paving the way for a federal trial to begin on Thursday.
Eight Mile Style LLC, Eminem's music publisher, had accused iPod maker Apple in a 2007 lawsuit of having used 93 songs in a downloadable format on iTunes without permission.
It also sued Aftermath Records, saying it had no right to approve digital downloads, despite having control of Eminem recordings under agreements entered into in 1998 and 2003.
The non-jury trial is expected to be held in federal court in Detroit, Eminem's hometown.

Beyonce will perform her first concert in Kuala Lumpur, Malaysia on Oct. 25, two years after she withdrew from a show over issues with the local dress code.
The Sony Music artist courted controversy after booking the 2007 show, which led to protests from the opposition Islamic Party's youth wing.
The Nov. 1, 2007 Beyonce show was canceled by the promoter. Although no official reason was given, at the time industry sources said it was down to the artist being unwilling to adhere to the dress code regulations. Female performers are required to cover up in the country, which has various rules for performances, including no foul language, or kissing or hugging audience members of fellow performers.

Jay-Z may make it a second week at No. 1 on the Billboard 200 albums chart next week as his "Blueprint 3" could fend off some hot competition from two new releases as well as Whitney Houston's former chart-topper.
Muse's "The Resistance" and Kid Cudi's debut album "Man on the Moon: The End of Day," which came out on Tuesday, are both looking to sell around 120,000 copies each during the week ended September 20, according to industry prognosticators. Muse could go a tad higher when data are released on Wednesday, while Cudi may finish the week a shade lower.
For Muse, "The Resistance" will give the band its best sales week ever and its highest charting album, too. Its previous high came when 2006's "Black Holes and Revelations" debuted and peaked at No. 9 with 48,000.

The final numbers are in for Lil Wayne's 2008-2009 North American touring, and it appears the rapper will have the highest grossing hip-hop outing of the year -- and the most lucrative rap jaunt that Billboard has ever tracked.
Seventy-eight Lil Wayne headlining arena and amphitheater concerts in North America from December 14, 2008, through September 6, 2009, grossed about $42 million and drew nearly 804,000 fans, according to Shawn Gee, Lil Wayne's tour producer and tour business manager.
"It's definitely one of the biggest in the last couple of years," Gee tells Billboard.com. "Our plan was to prove that Wayne was a viable headlining arena artist."
Jay-Z's "Blueprint 3" Pushed Up To Sept. 8thSubmitted by Str8hiphop.com on September 6, 2009 - 2:45am. Jay-Z's "The Blueprint 3" becomes the latest superstar album release to shuffle its release date, according to date changes on Amazon.com, Rhapsody.com and WEA's distribution Web site.
The Roc Nation set, originally scheduled for release on Sept. 11, has been pushed forward to Sept. 8. The title was intended to drop on Sept. 11, on the eighth anniversary of the first "Blueprint's" release.
Representatives for Jay-Z and Roc Nation could not be reached for comment at deadline.
Release dates are seemingly becoming more fluid as the music industry marches towards the all-important holiday shopping season. Just last week saw Miley Cyrus' Wal-Mart exclusive EP "The Time Of Our Lives" scoot forward from an Aug. 31 release to Aug. 28. Whitney Houston's comeback album "I Look To You" jumped one day from Sept. 1 to Aug. 31 -- which ultimately triggered a near industry-wide shift for all Sept. 1 albums to Aug. 31.
Max B Sentenced To 75 YearsSubmitted by Str8hiphop.com on September 4, 2009 - 3:54pm. Harlem, New York rapper Max B. was sentenced to 75 years in prison today (September 3) for his role in a botched robbery that led to a double murder in a Fort Lee, New Jersey hotel.
Max B., born Charly Wingate, appeared in a Hackensack, New Jersey court today with co-defendant Kevin Leerdam.
Max B. and Leerdam were convicted on charges of felony murder, kidnapping and armed robbery for planning and robbing Allan Plowden and David Taylor at a Holiday Inn in September of 2006.
Taylor was shot and killed during the robbery, which was planned with Max B.’s ex-girl friend Gina Conway, who testified against the pair during their June trial.
50 Cent Family Day CanceledSubmitted by Str8hiphop.com on August 29, 2009 - 10:52pm. A planned community event featuring rapper 50 Cent was canceled in its entirety out of fears of violence the rap star’s manager has confirmed.
50 Cent had planned to perform and host the event tomorrow (August 30) at PS 40 in Jamaica, Queens but nixed the event.
According to 50 Cent’s manager and Violator CEO Chris Lighty the event may still take place at a later, unconfirmed date. "We are postponing it and working it out with police," Lighty said.
Today (August 29), 50 Cent will play a safe gig at Six Flags Great Adventures in Northern New Jersey.
The rapper, along with vitaminwater, is busing hundreds of children from his old Queens neighborhood to the theme park to attend a fundraising performance for his G-Unity Foundation.
Juelz Santana Arrested Fot Threatening GirlfriendSubmitted by Str8hiphop.com on August 26, 2009 - 2:36pm. Harlem rapper Juelz Santana was arrested this morning (August 25) after allegedly threatening to kill the mother of his child.
According to reports, the woman called 911 this morning during a domestic dispute at their Teaneck, New Jersey home.
Although the wife did not need medical attention, Juelz, born LaRon James, was officially arrested on domestic battery charges.
"Police were called to Juelz Santana's home in Teaneck, New Jersey at 10:00 am after an argument between him and his son's mother," a rep for Juelz confirmed with AllHipHop.com. "LaRon James p/k/a Juelz Santana was then arrested and after review of the incident, police quickly released him. Santana is now resting comfortably at his home."
